Kaha Campervans – Rental Agreement (Terms & Conditions)
This Rental Agreement (“Agreement”) applies to all customers (“Hirer”) who hire a vehicle (“Vehicle”) from Kaha Campervans Limited (“Kaha Campervans”).
By proceeding with a booking, payment, or collection of any Vehicle, the Hirer agrees to be bound by the following terms and conditions.
1. Agreement to Hire
1.1 Kaha Campervans agrees to rent the Vehicle to the Hirer on the terms of this Agreement.
1.2 The rental period (“Hire Term”) begins and ends at the dates and times confirmed at booking.
1.3 Kaha Campervans may substitute the Vehicle with an equivalent or better model if necessary.
1.4 If the Vehicle is returned outside of staffed hours, the Hirer remains responsible for the Vehicle, including any damage or fees, until Kaha Campervans has inspected and checked it in.
2. Payments and Charges
2.1 The Hirer must pay the full hire cost and a deposit of $500 at the time of booking.
2.2 Rental charges are calculated per 24-hour day. A partial day counts as a full day unless otherwise agreed.
2.3 Additional fees may apply, including but not limited to:
- Additional driver fee: $15 per driver
- Refuelling fee: cost of fuel plus $35 (if not returned full)
- Cleaning or smoking fee: typically $300
- Late return: daily rate plus $250 late fee
- Incorrect return location: relocation fee $625 – $2,500
- Card payment surcharge: 2.5% (Visa/Mastercard), 4% (Amex/JCB)
- Default interest: 10% per annum on overdue amounts
2.4 The Hirer authorises Kaha Campervans to deduct from the $500 security deposit any unpaid amounts, infringement charges, tolls, damage costs, administration fees, or other amounts payable under this Agreement.
3. Use of the Vehicle
3.1 The Vehicle must only be driven by the Hirer or additional drivers approved by Kaha Campervans.
3.2 All drivers must:
- Be at least 21 years old; and
- Hold a current and valid full driver’s licence.
If the driver’s licence is not in English, the driver must carry either:
- An approved English translation issued by a NZTA-authorised translator; or
- A valid International Driving Permit (IDP) issued in accordance with the United Nations Convention on Road Traffic.
The licence must be legally valid for driving in New Zealand for the duration of the Hire Term.
3.3 The Hirer must:
- Take reasonable care when using the Vehicle.
- Lock the Vehicle when unattended.
- Comply with all New Zealand traffic laws and road rules.
- Use the correct fuel or charging method.
- Notify Kaha Campervans (0800 86 2828 or accidents@kaha-campervans.co.nz) immediately of any damage, accident, or fault.
3.4 The Hirer must not:
- Smoke or vape in or around the Vehicle.
- Carry animals, except approved disability assist dogs.
- Drive under the influence of alcohol or drugs.
- Sublet, hire out, or use the Vehicle for reward.
- Drive off-road, on beaches, through rivers or floodwaters, or on unsafe or prohibited roads.
- Carry more passengers or weight than legally allowed.
- Tamper with the odometer, GPS, or tracking systems.
4. Condition and Maintenance
4.1 Kaha Campervans will provide the Vehicle in a safe, roadworthy condition.
4.2 The Hirer must maintain fluid levels, tyres, and general care if the hire exceeds 21 days.
4.3 If the Vehicle becomes unsafe or unroadworthy, the Hirer must stop driving and contact Kaha Campervans or roadside assistance immediately.
5. Insurance
5.1 Vehicle Insurance
Each Vehicle is insured under Kaha Campervans' motor vehicle insurance policy, subject to the terms and conditions, limitations, and exclusions of that policy. The Vehicle remains insured under Kaha Campervans' policy at all times during the Hire Term
5.2 Mandatory Insurance Selection
All Hirers are required to purchase the mandatory Risk Taker Insurance, which carries a maximum excess of $3,000 per claim.
The Hirer may elect to upgrade to the option Happy Camper Insurance, which reduces the maximum excess to $500 per claim.
Insurance excess applies per incident or claim.
5.3 Liability for Excess
The Hirer is liable for the applicable insurance excess for each event of damage, loss, or accident unless:
- The Hirer is proven not to be at fault; and
- The full name, address, contact details, vehicle registration number, and insurer of the responsible third party are provided and verified.
Until fault is determined and third-party recovery is confirmed, the Hirer remains liable for the applicable excess.
5.4 Exclusions
Insurance does not cover (and the Hirer remains fully liable for):
- Damage resulting from unauthorised, reckless, or careless use);
- Off-road driving, water immersion, river crossing, beach driving, roof or underbody damage;
- Use on prohibited roads;
- Incorrect fuel or incorrect charging of onboard batteries;
- Driving by an unauthorised or unlicensed driver;
- Lost, stolen, or damaged personal property or accessories;
- Damage occuring while breaching any term of this Agreement.
5.5 Travel Insurance
The Hirer may obtain separate travel insurance for personal belongings or trip-related costs. Such travel insurance does not replace or override the vehicle insurance provided by Kaha Campervans.
5.6 No Waiver of Liability
Selection of any insurance option does not limit the Hirer's liability for damage, loss, or costs that fall outside the coverage or exclusions of Kaha Campervans' motor vehicle insurance policy.
6. Liability
6.1 The Hirer is liable for:
- Any loss or damage to the Vehicle, accessories, or third-party property, up to the value not covered by insurance.
- All associated costs, including towing, recovery, cleaning, or loss of rental income.
6.2 Kaha Campervans is not liable for any loss or damage suffered by the Hirer arising from the use, misuse, or breakdown of the Vehicle, except as required by New Zealand law.
7. Breakdowns and Assistance
7.1 All Vehicles are covered by AA Roadside Assistance.
7.2 For mechanical breakdowns not caused by driver error, the callout fee will be refunded.
7.3 For non-mechanical issues (e.g., out of fuel, lost keys, flat battery), the Hirer is responsible for callout and towing fees unless otherwise stated.
7.4 The Hirer must not arrange repairs without approval, except to prevent further damage.
7.5 Kaha Campervans will replace or repair the Vehicle as soon as practicable in the case of a mechanical fault not caused by the Hirer.
8. Accidents and Damage
8.1 In case of an accident or damage, the Hirer must:
- Notify Kaha Campervans immediately at 0800 86 2828 or accidents@kaha-campervans.co.nz.
- Contact Police and obtain a report where practicable.
- Not admit liability.
- Provide full details of all parties and witnesses within 72 hours.
8.2 If the Vehicle is unfit to drive and the Hirer is not at fault, Kaha Campervans will provide a replacement where possible.
8.3 A Damage Administration Fee of $75 incl. GST applies to all damage claims.
8.4 If the Vehicle is stolen, the Hirer must file a Police report and surrender the keys.
9. Fines and Infringements
9.1 The Hirer is responsible for all speeding, parking, toll, traffic, or other infringement notices incurred during the Hire Term.
9.2 All infringement notices and associated charges may be deducted from the Hirer’s $500 security deposit held at the time of booking.
9.3 If the total amount of any infringement notices and applicable administration fees exceeds the $500 security deposit, the Hirer remains legally liable for the outstanding balance. The Hirer agrees to pay any such amount within seven (7) days of receiving written notice from Kaha Campervans.
Failure to make payment within this timeframe may result in debt recovery action, and any reasonable recovery costs incurred may be added to the outstanding amount.
9.4 Kaha Campervans may charge the Hirer an administration fee of $60 per infringement notice to cover processing, handling, and associated administrative costs.
9.5 Toll notices paid by Kaha Campervans on behalf of the Hirer will incur an additional administration fee of $30 per toll notice, in addition to the toll charge itself.
9.6 The Hirer authorises Kaha Campervans to charge their nominated payment method for any such amounts without further notice.
10. Vehicle Return
10.1 The Vehicle must be returned at the agreed time and location.
10.2 Returning late may incur additional daily rates and a $250 + GST late fee.
10.3 Early returns do not qualify for refunds unless agreed in writing.
10.4 Vehicles returned excessively dirty, damaged, or missing accessories will be subject to cleaning or replacement charges.
11. Cancellations and Amendments
11.1 Cancellation Notice
All cancellations must be made in writing (email is acceptable) and are effective from the date received by Kaha Campervans.
For the purpose of this clause, the 7-day period is calculated from 12:00am on the seventh (7th) day prior to the scheduled pickup date.
11.2 Cancellations
More than 7 days before pickup:
If the booking is cancelled more than seven (7) days prior to the scheduled pickup date, the Hirer is entitled to a full refund of all monies paid, less a $50 + GST administration fee.
Within 7 days of pickup:
If the booking is cancelled within seven (7) days of the scheduled pickup date, no refund will be provided.
11.3 Booking Amendments (Reduction or Extension of Hire Period)
If the Hirer requests to reduce or extend the total number of booked hire days:
More than 7 days before pickup:
- If reducing the hire period, the difference in hire charges will be refunded, less a $50 + GST administration fee.
- If extending the hire period, the Hirer must pay the additional hire charges. No administration fee applies unless otherwise advised.
Within 7 days of pickup:
- If reducing the hire period, no refund will be provided for unused or removed hire days.
- If extending the hire period, the request is subject to vehicle availablility and must be paid in full prior to confirmation. No administration fee applies unless otherwise advised.
11.4 Refund Processing
- Approved refunds will be processed within ten (10) working days.

For booking deposit refunds, processing may take up to twenty (20) working days to allow time for any potential infringements or outstanding charges to be identified and assessed.
11.5 Consumer Law
Nothing in this clause limits or excludes the Hirer's rights under the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer protection legislation.
12. Privacy and Data
12.1 Kaha Campervans collects personal information to manage bookings, verify identities, ensure vehicle safety, and comply with legal obligations.
12.2 The Hirer consents to the use of GPS tracking for security, theft prevention, and operational purposes.
12.3 Information may be shared with insurers, law enforcement, and service partners as necessary to administer this Agreement.
13. General Terms
13.1 All transactions are in New Zealand dollars (NZD). Currency or exchange rate differences are at the Hirer’s expense.
13.2 This Agreement is governed by the laws of New Zealand.
13.3 If any clause is invalid, the remaining terms remain enforceable.
13.4 This document constitutes the entire agreement between Kaha Campervans and the Hirer.
13.5 By accepting a booking, making payment, or taking possession of the Vehicle, the Hirer confirms that they have read, understood, and agreed to all terms in this Agreement.
By completing a booking or collecting a Vehicle, the Hirer agrees to all terms in this Rental Agreement.
